Benjamín ; con el ánimo de atentar contra la indemnidad e integridad sexual de María Dolores y aprovechando que la misma acudía los fines de semana a casa de su padre el cual vivía en el piso de abajo del acusado, sito en la CALLE000 número NUM000 de la localidad de San Cugat del Vallés, así como aprovechando que la menor también acudía a ver a su hermana Esperanza (la cual convivía con el acusado desde que tenía aproximadamente 19 años de edad mediante el alquiler de una habitación que el acusado le proporcionó en la citada vivienda), en fecha indeterminada pero en todo caso durante los años 2012, 2013 y 2014 sometió a la menor María Dolores a distintos actos de naturaleza sexual, que se relacionan a continuación: a) Durante los años antes citados, y aprovechando las visitas que realizaba la menor a su padre, le profirió las siguientes expresiones de alto contenido sexual las siguientes "QUE TENÍA GANAS DE TOCARLE EL CHOCHO", "CHÚPAME LA POLLA" "CHÚPAME EL CULO", a cambio de ofrecerle en algunas ocasiones dinero, ropa, o recargas de móvil. Así mismo el acusado también profirió las siguientes expresiones durante este tiempo: "TE DARÉ UN CARAMELO SI ME HACES UNA PAJA" a lo que ella siempre contestaba que no; "TE PONGO UN POCO DE CREMA","¿QUIERES QUE TE META EL DEDO POR EL CHOCH0?","¿ME CHUPAS LA POLLA?".- b) Que al menos en una ocasión, mientras le profería estas expresiones, cogió el acusado con fuerza a la menor de su cabeza y la colocó en sus partes genitales mientras ella se negaba, obligándole a practicar una felación.- c) Que en fecha indeterminada pero en todo caso durante los años antes citados, en una ocasión la menor María Dolores se quedó con su hermana Encarna a dormir en casa del acusado, y éste le tocó la vagina.- d) Que así mismo en otra ocasión el acusado le puso crema en los genitales y en el culo y le introdujo el dedo en el ano. Que esta introducción se ha producido al menos en dos ocasiones, en las que el acusado, pese a la insistente negativa de la menor, con el objetivo de conseguir su propósito, logré introducir el dedo en la zona anal de la misma en estas dos ocasiones.- e) En otra ocasión, el acusado, aprovechándose de la situación de vulnerabilidad de la menor como en las situaciones anteriores descritas, le dijo "DAME LA MANO QUE VAMOS A COMPRAR", y entonces cogió la mano de la menor y acto seguido le dijo "PUES NO VAMOS A COMPRAR" le hizo tocar su pene. Que luego ella le quitó la mano. Ese día le salió semen al acusado, que el mismo le decía "QUE ERA PIPI". Que esto ocurrió en al menos en 3 ocasiones en las que el acusado siempre utilizaba la misma técnica de "contraprestación" a la menor, indicándole que a cambio "le compraría chuches o unas bambas chulas", a pesar de la negativa insistente de la menor para que cesara en sus actos.- 2°). Así mismo en fecha indeterminada, pero en todo caso entre los años 2011 y 2014, el acusado guiado por el mismo ánimo libidinoso y aprovechando idénticas circunstancias a las antes expuestas, cuando las menores iban de visita a casa de su padre y subían a ver a su hermana Esperanza a casa del acusado Benjamín , realizó varios tocamientos en el pecho y en la vagina de la menor Encarna , sin introducción de miembros ni objetos.- Del mismo modo y a cambio de darle dinero, recargas de móvil, ropa y otros regalos, y en el periodo de 5 meses antes de la detención de Benjamín (que tuvo lugar el 29/1/2015), le pedía a la menor que le enviase fotos en las que apareciesen sus genitales y del pecho, y que le solicitaba que se masturbase, no queda debidamente probada la recepción de dichas fotografías por parte de Benjamín .- De esta manera ocurrieron los siguientes hechos: a) El primer acto de contenido sexual que el acusado Benjamín cometió a la menor Encarna fue, cuando la misma tenía la edad de 13 años, (estando la menor en un centro de acogida desde los 8 a los 13 años de edad), antes de salir del centro y aprovechando el acusado -al igual que en las otras ocasiones las visitas que la menor mantenía con su padre-, un día indeterminado pero en todo caso entre el años 2011 y 2012 cuando la menor tenía 13 años de edad, en una de las ocasiones que fue a casa de su padre y subió a casa del acusado, le tocó el culo, y luego comenzó a tocarle sus pechos y su zona genital.- b) En otro episodio, la menor fue a casa del acusado y el mismo cuando esta se encontraba estirada en la cama comenzó a tocarle sus pechos y le ofreció la cantidad de 50 euros a cambio de introducirle el pene en su vagina, a lo que la menor se negó y el acusado, aprovechando idéntica ocasión dado que estaban tumbados en la cama, se acercó a la misma aproximando su cuerpo al de la menor para conseguir su objetivo sin éxito, dado que la menor hizo presión sobre la barriga del acusado y consiguió apartarlo. Acto seguido le metió el dedo en su vagina, sin introducirlo.- c) Que en otras ocasiones el acusado le dijo que "le hiciera una paja" ofreciéndole así mismo una contraprestación económica. Ese día, su padre tocó en la ventana y él se fue corriendo, no siendo vistos porque estaba cerrada.- d) Durante este tiempo el acusado ofrecía dinero a la menor, diciéndole expresiones tales como que "LE QUERÍA FOLLAR, QUE LE DABA 100 EUROS POR FOLLAR". En una de estas ocasiones, le llegó a dar 40 euros y que la menor le masturbó.- Todos estos actos de contenido sexuales fueron realizados por el acusado sobre la menor Encarna en la edad comprendida entre los 13 a los 16 años, situación que cesó cuando se produjo la detención del referido acusado.- TERCERO.- HECHOS PROBADOS del acusado Justiniano . El referido acusado, guiado por el mismo ánimo libidinoso que el otro acusado, atentó contra la libertad e indemnidad sexual de las menores María Dolores Y Encarna , en fecha indeterminada pero en todo caso durante año 2013 y 2014, en algunas ocasiones en su casa sita en la localidad de Las Planas (St Cugat del Vallés) y otras en la casa familiar que tiene en Gerona (propiedad de su hermana) y que se detallan a continuación: 1º) Respecto de la menor María Dolores , nacida el NUM004 /2005, el acusado guiado por el ánimo antes referido, durante los años 2013 y 2014 profirió las siguientes expresiones a la menor tales como: "TÓCAME LA POLLA", "¿TE METO EL DEDO EN EL CULO?", "SI ME DAS UN BESO EN LA BOCA TE DOY DINERO", "¿TE METO LA POLLA EN EL CULO?" a lo que ella le decía siempre que no.- a) En varias ocasiones en que la menor se quedó a dormir en la casa de LAS PLANAS del acusado Justiniano , él mismo introdujo su pene dentro del ano de la menor. Una vez en la cama fue cuando Justiniano le metió el pene en el ano, que le bajó los pantalones y las bragas y se la metió parcialmente, saliéndole un poco de semen, quedándose dormida la referida menor, causándole dolor y esto sucedía cuando estaban los dos solos. A veces dormían los tres juntos Encarna , ella y Justiniano , y que otros días ha dormido María Dolores sola con Justiniano . Que normalmente dormía con su hermana y otras veces no.- b) Durante este periodo y en otra ocasión, el acusado pidió un beso a la referida menor, a lo que ella contestó negativamente. De esta forma estos actos se producían de manera habitual y continuada, cada vez que la menor acudía a casa del acusado Justiniano como consecuencia de la relación de confianza que el mismo mantenía con el padre de la menor. Así, en otra ocasión le pidió un beso con lengua a lo que ella se negó. En otra ocasión, le dió un beso en su zona genital cuando estaba dormida en el sofá en la casa del acusado.- c) El acusado, guiado por el mismo ánimo libidinoso de atentar contra la indemnidad sexual de la referida menor, durante este tiempo le obligó a quitarse la ropa y las bragas y a veces que las bajaba y le desnudaba el acusado; que después de quitarle las bragas él quería que se abriese, y que le agarró fuerte de su mano y con la otra le puso su pene en la vagina y se la introdujo en su vagina; que en más de cuatro ocasiones le introdujo el dedo en su vagina y al menos en cuatro ocasiones en su ano, causándole dolor; que asimismo, el acusado le cogió con fuerza la cabeza para acercarla a sus genitales sin llegar a hacerle una felación; que en varias ocasiones -al menos en tres ocasiones- le masturbó siendo obligada porque le cogía la mano y se la ponía en sus genitales; que el acusado le chupaba la zona genital en varias ocasiones.- d) Finalmente el acusado solicitaba a la menor María Dolores fotos desnuda y vídeos de alto contenido pornográfico y sexual, en algunas ocasiones por vía WhatsApp a cambio de contraprestaciones similares a las anteriores, dinero, recargas de móvil y otros regalos. Uno de estos vídeos fue grabado por su hermana Encarna a petición del acusado, en el verano de 2014 donde la menor exhibe de manera clara sus partes genitales. En otra ocasión grabó e hizo fotos a la menor en la ducha, cuando esta se encontraba en la casa de vacaciones en GIRONA en fecha indeterminada del año 2014.- 2°) Respecto de la menor Encarna , el referido acusado Justiniano , guiado por el mismo ánimo de atentar contra la libertad e indemnidad sexual de la referida menor Encarna , nacida el NUM005 /1998, en fecha indeterminada pero durante también los años 2013 y 2014, cometió las siguientes conductas de contenido sexual respecto a Encarna .- a) De manera habitual -al igual que lo hacía con su hermana María Dolores , en la casa de LAS PLANAS-, en diversas ocasiones en que se quedó a dormir con su hermana María Dolores en la casa del acusado, tocó los pechos y las partes genitales de la menor cuando esta dormía junto con su hermana en la misma cama de una de las habitaciones. Te toco los pechos teniendo la ropa puesta, para luego quitarle el sujetador y le tocó la zona genital y le introducía el dedo, aconteciendo estos hechos en la cama de Justiniano . Que uno de estos hechos, la menor fue sola a casa de Justiniano a comer, que le ofreció 30 euros y le empezó a tocar, que le tocó los pechos y le quitó la camiseta y los pantalones y a continuación le introdujo el dedo y se hizo una masturbación delante suya. Que la introducción del dedo en su zona vaginal aconteció unas 3 o 4 veces.- b) Así mismo a partir de Diciembre de 2014, el acusado comenzó a solicitar fotos y vídeos de la menor en las que saliera desnuda y exhibiendo sus partes genitales o pecho a cambio de determinadas contraprestaciones consistentes en dinero, regalos y recargas de móvil. En otra ocasión, la menor sorprendió al acusado grabándola con su móvil en la ducha.- c) Durante el mismo periodo de tiempo, el acusado guiado por el mismo ánimo ofreció a la menor diferentes cantidades de dinero a cambio de que aquella accediera a sus peticiones sexuales; una vez sentados en la cama le dijo que si le hacía una paja le recargaba 10 euros en el móvil y la menor le hizo una masturbación siendo concluida por el acusado. Que las masturbaciones que le hizo la menor siempre se las hizo con la mano, al menos en 5 veces. Que en las masturbaciones siempre le ofrecía 10/15 euros o recargas al móvil de la menor. Que en una ocasión, en el salón de la casa de Justiniano le tocó los pechos y se los chupó.- d) Así mismo, durante el año 2014, durante 5 días que las menores fueron en compañía del padre a la casa de vacaciones del acusado en GIRONA, el acusado le realizó diversos tocamientos; y así, en una de las ocasiones, se estiró en la cama donde dormía la menor y le tocó su parte trasera a lo que la menor le dijo: "QUÉ HACES AQUÍ" y él le respondió "es la casa de mi hermana puedo estirarme donde quiera".- CUARTO.- Que como consecuencia de los hechos descritos, mediante Auto de fecha 29 de Enero de 2015 se acordó la entrada y registro en los domicilios del acusado Benjamín sito en la CALLE000 número NUM000 de la localidad de San Cugat del Valles y de Justiniano sito en la CALLE001 número NUM006 también de la localidad de San Cugat del Vallés.- Que como resultado de la práctica de dicha entrada y registro fueron intervenidos varios efectos en el citado domicilio de Justiniano , encontrándose material pornográfico relacionado con menores de edad y con las menores María Dolores y Encarna de los efectos intervenidos en el referido domicilio de Justiniano y que se exponen a continuación; no así se intervino ni terminal telefónico de última generación ni soportes de almacenamiento informático en el domicilio del acusado Benjamín : En el domicilio de Justiniano se intervino: - En el Indicio PA1, disco duro SEAGATE del ordenador HP 17-1004NS se encontraron diversas fotos y vídeos en donde aparecen siglas tales como PTHC (Pree TeenHard Core) en las que se muestras a adultos manteniendo relaciones sexuales con menores de edad, así mismo en el disco duro se encuentra el programa P2P de intercambio de ficheros "ARES", y se extrae un listado de búsqueda de archivos relacionados con imágenes y contenidos sexuales donde aparecen menores de edad.- También dentro de este disco duro se encuentra el vídeo realizado por Encarna , en el que aparece la menor María Dolores mostrando sus genitales. - También se encuentran imágenes en la tableta CHUWI (Indicio PA5), concretamente se encuentran numerosas fotografías de la menor Encarna realizadas por ella misma cuando se las solicitaba el acusado en donde se muestra desnuda, con sus pechos y zonas genitales.
